Town of Ridgway

RESOLUTION NO. 05-01

WHEREAS, the Town Council believes there is a serious need for capital improvements to improve the Town’s existing infrastructure which can be met in part by a 0.6% increase in the rate of the Town’s Sales Tax, and

 

WHEREAS, the Town Council desires to earmark that portion of the 0.6% sales tax increase attributable to the tax on food for park purposes and the remainder of such increased proceeds to construct, acquire, and finance capital improvements and equipment with street, sidewalk and storm drainage improvements within the HB District being the top priority.

BE IT RESOLVED by the Town Council of the Town of Ridgway, Colorado, as follows:

 

Section 1. There is hereby referred to the voters at the regular municipal election of April 5, 2005, Referred Measure "A", the ballot title and text of which are as follows:

 

Ballot Title and Text:

TOWN OF RIDGWAY - REFERRED MEASURE "A"

 

SHALL TOWN OF RIDGWAY TAXES BE INCREASED $100,000 ANNUALLY, BEGINNING IN 2006 WHICH WILL BE THE FIRST FULL FISCAL YEAR OF THE INCREASE, AND BY WHATEVER ADDITIONAL AMOUNTS ARE RAISED ANNUALLY THEREAFTER, BY INCREASING THE RATE OF THE TOWN’S SALES TAX FROM 3% TO 3.6%, WITH THE PROCEEDS FROM SUCH INCREASE PLEDGED TO PARK PURPOSES TO THE EXTENT ATTRIBUTABLE TO THE TAX ON FOOD, AND WITH THE REMAINING PROCEEDS OF SUCH INCREASE PLEDGED FOR THE ACQUISITION AND CONSTRUCTION OF CAPITAL IMPROVEMENTS AND EQUIPMENT AND THE FINANCING THEREOF, AND SHALL THE  TOWN OF RIDGWAY, COLORADO, BE PERMITTED TO COLLECT, RETAIN, AND SPEND THE FULL PROCEEDS OF THE INCREASE IN THE RATE OF THE TOWN’S SALES  TAX, INCLUDING INTEREST EARNED THEREON,  NOTWITHSTANDING ANY STATE RESTRICTION ON FISCAL YEAR SPENDING, INCLUDING WITHOUT LIMITATION THE RESTRICTIONS OF ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION, AND SHALL THE RIDGWAY TOWN COUNCIL BE AUTHORIZED TO ADOPT AN ORDINANCE IMPLEMENTING SUCH INCREASE AND USE OF THE PROCEEDS IN SUBSTANTIAL CONFORMITY HEREWITH?

Section 2. Any protest to the ballot title must be filed with the Town Clerk by February 14, 2005.  It shall be promptly resolved by the Town Council, following notice and hearing. 

Section 3. The Town Clerk and Town Manager are hereby authorized and directed to take all necessary and appropriate action  with respect to the submission of Referred Measure “A” to the electors and the holding of the regular election of April 5, 2005.
