CR5 landowners sue county for access to properties

Ten Upper County Road 5 property owners filed suit against the Board of County Commissioners on Jan. 25, following years of attempts at reconciling their right to property access versus recreationists’ claims to historical use of the road for winter sports and access to the national forest boundary.
The landowners requested a temporary restraining order and injunction against the county to allow full road snowplowing to their properties, but on Monday the parties stipulated to an agreement that mirrors the last winter maintenance agreement, executed in 2017.
